New development
Temporary exemption for F-gases in compressed air dryers
Implementing Regulation (EU) 2026/1975, published on 9 September, allows a limited exemption from the ban on the placing on the market of certain compressed air dryers using fluorinated gases with a global warming potential of at least 150. Specific stationary chillers up to 12 kW and autonomous air conditioning systems up to 50 kW used for drying are covered. The exemption applies from 1 January 2027 to 31 December 2030, subject to the required labelling. Manufacturers and importers must check the exact category, capacity and technical dossier of the equipment. This is not a general postponement of the restrictions on F-gases.
Renewed approval of pyraclostrobin with specific testing conditions
Implementing Regulation (EU) 2026/1976 renews the approval of pyraclostrobin from 1 October 2026. The new act, published on 9 September, sets maximum levels for the impurities dimethyl sulphate and toluene and requires special attention to co-formulants, aquatic organisms and consumer exposure to metabolites. The applicant must submit further data on metabolite 500M07 and on the impact of water treatment by 12 September 2028. Manufacturers, authorisation holders and testing laboratories should check their specifications and evidence. The renewal of the active substance does not replace the authorisation of the specific product and the assessment of its uses.
EU sets final responses to imports of two dangerous pesticides
By Implementing Decision (EU) 2026/1977, published on 9 September, the Commission sets out final responses to the refusal of consent for the import of carbosulfan and ultra-small volume formulations of fenthion with at least 640 g of active substance per litre. The decision is part of the prior informed consent procedure under the Rotterdam Convention and reflects existing EU restrictions. It should not be construed as a new general ban on all concentrations and uses of fenthion. Importers, exporters and chemical compliance officers should check the identity of the substances, formulations and documents along the supply chain.
ERO MN permission is restricted after comparative assessment
Implementing Regulation (EU) 2026/1974 authorises the biocidal product ERO MN for certain disinfection uses from 29 September 2026 to 31 August 2030. The comparative assessment identified suitable alternatives for the disinfection of animal premises and food and feed areas. Therefore, only the use for the disinfection of animal transport vehicles will be subject to renewal. The act published on 9 September is important for suppliers and businesses using the product or its trade names. The authorised application method, the product characteristics and plans for future substitution should be checked.
Bulgaria changes product taxes for electrical equipment
Decree No. 131 of 3 September 2026, published in the State Gazette, issue 82 of 8 September, replaces the table of product fees for electrical and electronic equipment. The new amounts include 1.04 EUR/kg for lamps, 0.16 EUR/kg for large appliances and photovoltaic panels and 0.15 EUR/kg for small information technology and telecommunications equipment. In the absence of a special provision, the act enters into force on 12 September, after the expiry of the three-day period from the promulgation. The affected enterprises must verify their product classification, masses and reporting systems. The specific liability should be checked against the applicable regime for the implementation of waste obligations.
The deadline for adapting company documents to the euro has been extended
From September 8, 2026, the period under Art. 32, para. 1 of the Euro Adoption Act has been extended from 12 to 36 months from the date of the introduction of the single currency. The change affects the bringing of company and internal documents into compliance with the law. The submission of copies upon subsequent application to the Commercial Register has also been clarified - in cases where the law requires this. Managers, legal and control functions should update the registers of obligations and plans for documentary changes. The extension is specific to this provision and does not mean a general postponement of the remaining obligations related to the euro.
Upcoming deadlines
T–7: the transition for some plastics in contact with food is completed
A key transition period under Regulation (EU) 2025/351 on plastic materials and articles in contact with food ends on 16 September 2026. Articles compliant with the previous rules and first placed on the market before that date may continue to be marketed until stocks are exhausted. This is not an obligation to withdraw all old stocks. For non-compliant intermediates and substances covered, specific guidance in the declaration of conformity applies. Manufacturers, importers and food business operators should check the date of first placing on the market, declarations and evidence of conformity along the chain.
T–14: Euro 7 moves to Regulation No. 179 for brake emissions
Delegated Regulation (EU) 2026/1214, published on 3 September, enters into force on 23 September 2026. It replaces the reference to Global Technical Regulation No 24 with UN Regulation No 179 on the laboratory measurement of brake emissions from light duty vehicles under Euro 7. The change concerns the test environment, particulate measurements and the assessment of new brake technologies. Manufacturers, technical services and laboratories should check the procedures and regulatory references in the test plans. The date is for the entry into force of this amendment; it should not be confused with any separate dates for the implementation of Euro 7.
T–14: banks must verify the link between BI and FINREP
Implementing Regulation (EU) 2026/1166 enters into force on 23 September 2026, two weeks after today’s review. The act, published on 3 September, links the components of the business indicator for operational risk to specific cells of the supervisory FINREP reports. Where there is no full compliance, the reported values must be adjusted according to the definitions in Delegated Regulation 2026/1167. Banks’ risk, finance and reporting teams should check the data sources, reconciliation rules and controls on adjustments. For internal audit, this provides a concrete basis for tracing the numbers from primary systems to the regulatory indicator.
T–14: new details on operational risk data and events
On 23 September 2026, Delegated Regulation (EU) 2026/1167 with technical rules on operational risk of credit institutions entered into force. The act, published on 3 September, specifies the components of the business indicator, adjustments for mergers and acquisitions and the classification of loss events. For acquisitions, the starting point is historical audited financial statements or specified historical financial information, and specific alternatives are applied in case of deficiencies. Bank risk and audit functions should review the methodologies, evidence and responsibilities for the data. This is a separate control issue from the technical reconciliation of BI with FINREP reports.
Strategic Watch
ISO 9001:2026: one week left until scheduled publication
As of September 9, ISO 9001:2026 remains at official stage 60.00 — preparing for publication. ISO has indicated September 16, 2026 as the planned date for replacing the 2015 edition. This is a T–7 reminder, not a notice that the new standard has already been published or that ISO 9001:2015 certificates are no longer valid. Organizations and certification bodies should plan to review the final text, auditor competence, and necessary system changes. Specific transitional arrangements should be consulted with the applicable accreditation rules and the relevant certification body.
T–30: Renugarant remains a RENURE certification project
The waiting period for notification TRIS 2026/0347/NL for the designation of Renugarant as a certification scheme for RENURE continues until 9 October 2026. The project includes requirements for production equipment, sampling, sampling frequency and product analysis. It is also envisaged that producers outside the Netherlands will participate, which creates cross-border relevance for suppliers, laboratories and certification bodies. Today's alert is a T-30 reminder for an already reflected project, and not a confirmation of an adopted measure. Interested organizations should check the text of the scheme and subsequent TRIS notifications; the end of the waiting period does not automatically mean entry into force.
Navarra offers packaging of protected wines only in the region
On 9 September, a request for amendment to the specification of the Navarra Protected Designation of Origin was published. It is proposed that wines be bottled only in registered wineries in the defined geographical area, on the grounds of preserving quality, origin and the effectiveness of controls. This is a draft new restriction on supply, not an existing ban on packaging outside the area. The publication opens a three-month objection procedure under Regulation (EU) 2024/1143. Producers, traders, external packagers and control bodies should assess their contracts and chains and check the applicable objection procedure.
A European digital consortium for the agri-food sector has been created
By Implementing Decision (EU) 2026/1978, the European Commission established the EDIC for Agri-Food, a European Digital Infrastructure Consortium based in Paris. The Decision was published and entered into force on 9 September 2026. Its mission is to develop and deploy interoperable digital solutions for agriculture and food in the EU. For producers, data providers and conformity assessment bodies, this is an early signal for future common infrastructures and exchange of evidence. The Decision itself does not introduce a mandatory traceability format or a new certification scheme. The practical next step is to monitor the specific projects, technical specifications and conditions for participation.
New EU guidelines on exclusionary practices of dominant companies
On 9 September, the Commission published guidelines under Article 102 TFEU on exclusionary conduct by dominant undertakings. The document covers access restrictions, refusals to supply, product tying and other practices, as well as possible objective justifications. For digital ecosystems and providers dependent on foreign infrastructure, issues of interoperability and technical justification for restrictions are particularly important. The guidelines are not a new regulation and do not bind courts as law. Companies should review contractual restrictions and the evidence of necessity, proportionality and effectiveness with a competent legal team, without assuming that every market restriction is automatically an infringement.
EU audit finds gaps in control of illicit tobacco trade
The European Court of Auditors published Special Report 23/2026 on the illicit tobacco trade on 8 September, published in the Official Journal on 9 September. The auditors found fragmented data, uneven cooperation and a lack of sufficiently clear common priorities. The recommendations aim at more reliable information, coordination and measurable results, with target years 2028 and 2029. These are not new deadlines for companies. For tobacco chains and control solution providers, the report is a signal to review data quality, traceability and transparency in their interactions with authorities. The findings are audit conclusions, not a new certification scheme.
Last days to participate in the evaluation of the dual-use regime
The Commission is accepting responses to a targeted consultation on the evaluation of Regulation (EU) 2021/821 on dual-use items until 11 September 2026, 23:59 CEST. This corresponds to 00:59 on 12 September in Sofia. The consultation was launched on 23 July and is reported here for the first time, not as a newly opened procedure. It is aimed at enterprises, small and medium-sized companies, industry organisations and research institutions with practical experience in export control. Participants should prepare concrete examples of compliance difficulties and evidence. Participation does not change the current authorisation requirements.
Consultation on data sovereignty is open until September 15
The Commission is collecting views on the dependencies and risks of international data use and transfer by 15 September 2026, 23:59 CEST — 00:59 on 16 September in Sofia. The consultation was launched on 8 July and last updated on 31 August; this is its first coverage in MOODY NEWS. Topics include access to data in third countries, data transfers to the EU and access by third countries to sensitive data. It is useful for cloud providers, international groups and audit functions to present specific contractual and technical difficulties. The procedure does not introduce a new general requirement for data localisation.
EU Forum Prepares Practical Internet Standards for NIS2
A Commission multi-stakeholder forum is developing guidelines for the implementation of Internet standards in support of NIS2 network requirements. The topics covered are network protocols, secure email, DNS and routing, related to point 6.7.2(j) to (l) of Implementing Regulation (EU) 2024/2690. The official page was updated on 3 August 2026; the topic is included as a previously unaddressed strategic signal. The guidelines and appropriate deadlines are still being developed and the call for expressions of interest remains open. Cloud, DNS and managed providers should follow the workflows and future technical criteria without accepting unpublished results as binding obligations.
ISO 45010:2026 adds guidance on menstruation and menopause in the workplace
ISO 45010:2026 was officially published on 7 September and is included as a previously unreported baseline framework for organizations. The standard offers guidance on supporting menstruation and menopause in the workplace through policies, training, appropriate conditions and evaluation of results. It is intended for different sizes and sectors and complements existing occupational health and safety practices. It is a guideline, not a new legal obligation, medical protocol or automatic requirement for separate certification. Employers, HR and OHS professionals should review the applicability to the work environment, while respecting privacy and individual needs.
MiCA review accepts specialist opinions until September 30
The Commission's targeted consultation on the review of the Markets in Crypto-Assets Regulation MiCA remains open until 30 September 2026, 23:59 CEST. The page notes an extension of the deadline, but the exact date of this change is not set; therefore, it is not presented as a new extension from today. The consultation was launched on 20 May and is first reported by MOODY NEWS. Crypto-asset service providers, issuers and supervisors can provide practical evidence of implementation. Responses will help to assess the regime; a possible future legislative proposal does not mean that the current requirements have already been changed.
Court decision on the identification of whistleblowers to the Bulgarian Anti-Fraud Office
In the State Gazette, issue 82 of September 8, Decision No. 8363 of the Supreme Administrative Court of July 27, 2026 was published. It declares the nullity of a specific requirement in the internal rules of the BFSA for a signature for paper signals and an electronic signature for electronic signals. The reason is a lack of competence to introduce these regulatory requirements. The text allows for a cassation appeal, and the finality has not been confirmed in the current inspection. For food operators and compliance functions, this is a signal to review the channels for submitting and registering signals, and before making any practical changes, check the current judicial status and the instructions of the BFSA.
