The new EU regime for cross-border electronic evidence is now in force

Regulation (EU) 2023/1543 on European Production and Preservation Orders for Electronic Evidence has been in force since 18 August. The regime covers providers of electronic communications, domain names and IP services, as well as communication, storage or data processing services, when they offer services in the EU. The usual time limit for production is up to 10 days, and in urgent cases up to eight hours. At the same time, providers falling under Directive (EU) 2023/1544 must now have a designated unit or legal representative for receiving and executing orders. Organisations should confirm their scope, on-call contact, powers, preservation, confidentiality and traceability procedures and evidence for each act received and executed.
New requirements for seven food additives come into effect

Regulation (EU) 2026/196 has been applicable since 18 August. It amends the conditions of use of carrageenan E 407, locust bean gum E 410, guar gum E 412, gum arabic E 414, xanthan gum E 415, pectins E 440 and starch sodium octenyl succinate E 1450, as well as the purity and microbiological control specifications of six of them. The changes are particularly important for foods for infants and young children. Manufacturers, suppliers and laboratories must check recipes, specifications, certificates of analysis, methods, limits for metals and microbiological criteria. The transitional provisions preserve certain legally produced additives and foods placed on the market, but require clear batch traceability and a distinction between the old and the new regime.
Upcoming deadlines
T–14: registration of accredited CBAM verifiers begins

The earliest possible date for requesting registration of accredited CBAM verifiers in the Carbon Border Adjustment Mechanism register is 1 September. The request is submitted to the competent authority of the country where the national accreditation body is established and must be made within two months of the granting of accreditation, but not before that date. This is a reminder of the T-14 threshold and not a new legal act. Applicants should confirm the scope and duration of the accreditation, the unique identifier, administrative arrangements, EU Login, authorised users and readiness to work with the register. National authorities and clients should also check the exchange of evidence and the schedule for the first verifications.
